This document is an electronic record under the Information Technology Act, 2000 ("IT Act") and the rules framed thereunder, as applicable and amended from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules 2021"), which require publishing rules, regulations, privacy policy, and terms of use for access to or usage of kunkupatri.com ("Website" or "Platform").

PLEASE READ THESE TERMS CAREFULLY. By accessing, browsing, or using the Platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform or any services offered through it. These Terms incorporate our Privacy Policy by reference.

Definitions

"Platform" or "KP" — The website kunkupatri.com and all associated services.
"Company", "We", "Us", "Our" — Qubitlance Media Private Limited, a company incorporated under the laws of India.
"User", "You", "Your", "Member" — Any individual who accesses or uses the Platform, whether registered or not.
"Registrant" — A parent, sibling, relative, or authorised person who creates or manages a profile on behalf of a prospective bride or bridegroom.
"Services" — All features and functionalities provided through the Platform, including profile creation, search, matching, messaging, and related services.
"Content" — All text, images, photographs, data, and other materials uploaded, posted, or shared on the Platform by any User.

1. Platform Role and Intermediary Status

KP is an online matrimonial platform owned and operated by Qubitlance Media Private Limited ("Qubitlance"). KP acts as an "Intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000.
KP provides a platform that enables Users to create profiles, search for prospective matrimonial matches from the database of registered Users, and communicate with each other for lawful matrimonial purposes.
KP is not a marriage broker, agent, or matchmaker. We do not participate in, arrange, negotiate, or guarantee any matrimonial alliance. All decisions regarding communication, meetings, and marriage are made solely by the Users.
KP does not verify, authenticate, or endorse any information provided by any User. Users are solely responsible for verifying the credentials and information of other Users.

2. Eligibility

To register on or use the Platform, you must meet the following criteria:

Nationality: You must be an Indian national, a Person of Indian Origin (PIO), a Non-Resident Indian (NRI), a person of Indian descent or heritage, or a person who intends to marry a person of Indian origin.
Age: You must be at least 18 years of age (if female) or 21 years of age (if male), in accordance with applicable Indian marriage laws.
Legal Capacity: You must be legally competent to enter into a marriage under the laws applicable to you. If you are a resident of a country other than India, you must also comply with Indian laws for marrying a person of Indian origin.
Single Account: Only one account per person is permitted. Duplicate profiles are not allowed, and KP reserves the right to suspend or terminate duplicate accounts without notice.
Registrant Consent: If you are a Registrant creating a profile on behalf of another person, you represent and warrant that you have obtained their explicit consent to create the profile and share their information on the Platform.

3. Registration and Account

Registration Methods: You may register using email and password, Google Sign-In, phone number with OTP, or email link verification, as available on the Platform.
Accurate Information: You must provide true, accurate, current, and complete information during registration and while updating your profile. This includes personal details, photographs, family information, and partner preferences. You must not enter information in fields other than the applicable field.
Profile Wizard: After initial registration, you will be required to complete a profile wizard to provide essential matrimonial information. Incomplete profiles may have limited access to Platform features.
Verification: You may be required to verify your email address and phone number.
Matrimonial Intent: Your registration and use of the Platform must be with the bona fide intention of seeking a lawful matrimonial alliance. Use of the Platform for any commercial, fraudulent, or non-matrimonial purpose is strictly prohibited.
Inaccurate Information: If KP has reason to believe that any information provided by you is untrue, inaccurate, or incomplete, KP reserves the right to suspend or terminate your account without notice and forfeit any amounts paid towards membership.

4. Account Security

You are responsible for safeguarding the confidentiality of your login credentials, including your password, OTP, and any other authentication mechanism.
You must restrict access to your devices to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account.
KP will never ask you for your password. Do not share your password or OTP with any person, including anyone claiming to represent KP.
You agree to use secure devices, software, and networks when accessing the Platform.
If you become aware of any unauthorised use of your account, you must notify us immediately at support@kunkupatri.com.

5. Verification and Trust

Email and Phone Verification: Users are required to verify their email address and phone number as part of the registration process.
AI-Powered Scoring: KP may use automated systems, including artificial intelligence, to evaluate profile completeness, consistency, and trustworthiness. Such scores are indicative only and do not constitute a guarantee of authenticity.
Admin Review: KP administrators may review profiles for compliance with these Terms. Profiles found to be in violation may be suspended or removed.
No Guarantee of Authenticity: Despite verification measures, KP does not guarantee the identity, background, character, or intentions of any User. You are solely responsible for exercising due diligence before engaging with any User.

6. Membership and Payments

Subscription Model: Access to certain features of the Platform requires a paid annual subscription, payable in Indian Rupees (INR).
Payment Processing: Payments are processed securely through Razorpay, a third-party payment gateway. KP does not store your credit card, debit card, or banking details. All payment transactions are subject to Razorpay's terms and conditions.
Manual Renewal: Subscriptions do not auto-renew. You must manually renew your subscription before or after expiry to continue accessing paid features.
Grace Period: After your paid subscription expires, you will have a 30-day grace period during which your account remains accessible with restricted features. After the grace period, your account may be marked for deactivation, and you may lose access to your profile and data.
Free Features: Certain basic features of the Platform are available to registered Users without a paid subscription, subject to limitations.

7. Refund Policy

Non-Refundable: All payments made towards membership or subscription fees are non-refundable. No refunds will be issued for unused portions of a subscription, early termination, or any other reason.
No Transfer or Assignment: Membership cannot be transferred or assigned to any other person or entity. Any such attempt shall be treated as a violation of these Terms.
Forfeiture on Termination: If your account is terminated by KP for violation of these Terms, all amounts paid shall be forfeited.

8. User Responsibilities and Conduct

By using the Platform, you agree to the following:

Truthful Information: You will provide accurate and truthful information at all times and will update your profile promptly if any information changes.
Prohibited Conduct: You shall not:
- Provide false, misleading, or fraudulent information
- Create a profile for someone without their explicit consent
- Use the Platform for any commercial, promotional, or non-matrimonial purpose
- Seek or provide financial assistance from or to other Users
- Use abusive, discriminatory, hateful, or racially objectionable language
- Share confidential personal data of other Users, including bank details
- Harass, stalk, threaten, or intimidate other Users
- Upload obscene, pornographic, defamatory, or illegal content
- Impersonate another person or misrepresent your identity
- Use bots, web robots, scrapers, or any automated processes to access the Platform
- Probe, scan, or test the vulnerabilities of the Platform or its networks
- Attempt to circumvent any security measures implemented by KP
- Mention or promote competing matrimonial services in messages
- Make payments or transfer money to any individual employee of Qubitlance; all payments must be made only through the official Platform
Violation Consequences: Violation of any of the above may result in immediate suspension or termination of your account, forfeiture of subscription fees, and KP reserves the right to initiate appropriate legal action.

9. Privacy Controls

Photo Privacy: You may control the visibility of your photographs through privacy settings, including options to restrict photo access to Users you have approved.
Contact Information: Your phone number and address are private by default. Other Users may request access to your contact information, which requires your explicit approval.
Blocking: You may block any User at any time. Blocked Users will no longer be able to view your profile or communicate with you.
Search Engine Indexing: Profile pages are not indexed by search engines by default (noindex).

10. Communication Features

Interest Requests: Users may send interest requests to other Users. Recipients may accept, decline, or ignore such requests at their discretion.
Chat and Messaging: Paid members may access messaging features to communicate with other Users. All communications must be respectful and for genuine matrimonial purposes.
Notifications: KP may send you notifications via email, push notifications, or in-app messages regarding profile activity, matches, and Platform updates.
Consent to Communications: By registering on the Platform, you consent to receiving service-related communications from KP, including account notifications, security alerts, and feature updates. You may manage your notification preferences through your account settings.

11. Content Rights and Licence

KP Content: All content on the Platform that is not User-generated — including the website design, layout, text, graphics, logos, icons, software, and code — is the property of Qubitlance Media Private Limited and is protected by applicable intellectual property laws.
Your Content: You retain ownership of all Content you upload or submit to the Platform, including your photographs, profile information, and messages.
Licence Grant: By submitting Content to the Platform, you grant Qubitlance a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, display, distribute, and process your Content solely for the purposes of operating the Platform and providing the Services. This licence terminates when you delete your Content or close your account, except where your Content has been shared with other Users and they have not deleted it.
Content Moderation: KP reserves the right to review, edit, or remove any Content that violates these Terms or is otherwise objectionable, without prior notice.

12. Third-Party Services

The Platform integrates with the following third-party services:

Razorpay — For payment processing. Subject to Razorpay's Terms of Service.
Google Places API — For location-related features.
Google reCAPTCHA — For bot detection and spam prevention. Subject to Google's Privacy Policy and Terms of Service.
Firebase / Google Cloud — For authentication, database, hosting, analytics, and cloud messaging services.

KP does not control and is not responsible for the terms, policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the respective third party's terms and policies.

13. AI Usage Disclosure

KP uses artificial intelligence services provided by Anthropic (Claude) for the following purposes:
- Profile Verification Assistance: AI may be used to assist in reviewing profile information for consistency, completeness, and compliance.
- Customer Support: AI-powered support assists in responding to User queries and support tickets.
Data Shared with AI: Only summarised profile information (no photographs or payment details) may be shared with AI services for the above purposes. All data processing is subject to our Privacy Policy.
Human Review: Users may request human review of any decision or action taken with the assistance of AI by contacting us at support@kunkupatri.com.

14. Disputes Between Members

Users are solely responsible for all communications and interactions with other Users, whether through the Platform or otherwise.
KP expressly disclaims any responsibility or liability for any disputes, transactions, exchanges, or interactions between Users.
KP has no obligation to monitor or mediate disputes between Users and shall not be a party to any such dispute or legal proceeding.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Qubitlance, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform or Services.
Qubitlance's total liability to you for any claim arising out of or related to these Terms or your use of the Platform shall not exceed the amount paid by you to KP in the twelve (12) months immediately preceding the event giving rise to the claim.
Force Majeure: KP shall not be liable for any failure or delay in performing its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, network failures, or power outages.

16. Disclaimer of Warranties

The Platform and Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
KP does not guarantee or promise any specific results from the use of the Platform, including but not limited to finding a suitable match or entering into a marriage.
KP does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
KP does not authenticate, endorse, or guarantee the accuracy, completeness, or reliability of any Content posted by Users.

17. Indemnification

You agree to defend, indemnify, and hold harmless Qubitlance Media Private Limited, its subsidiaries, affiliates, directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your use of the Platform or Services
Your violation of these Terms
Your violation of any applicable law or the rights of any third party
Any Content you submit to the Platform
Any dispute between you and another User

This indemnification obligation shall survive termination of your account and these Terms.

18. Termination

Termination by KP: KP reserves the right to suspend or terminate your account, without prior notice and at its sole discretion, if you:
- Provide false, inaccurate, or misleading information
- Violate these Terms or any applicable law
- Engage in fraudulent, abusive, or harmful conduct
- Impersonate another person or create a fake profile
- Use the Platform for non-matrimonial or commercial purposes
- Seek financial or sexual favours from other Users
- Behave in an indecent or improper manner towards other Users or KP employees
Account Closure by You: You may close your account at any time through the Settings page on the Platform. You may also request account closure by emailing cancellation@kunkupatri.com.
Effect of Termination: Upon termination or closure, your right to access the Platform ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including disclaimers, limitations of liability, and indemnification.
Surviving Provisions: Termination does not relieve you of any obligations or liabilities arising prior to termination.

19. Modifications to Terms

KP reserves the right to modify these Terms at any time. Material changes will be communicated to registered Users via email or prominent notice on the Platform.
Your continued use of the Platform after such modifications constitutes acceptance of the revised Terms. If you do not agree with the modified Terms, you must stop using the Platform and close your account.

20. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.
Arbitration for NRI Disputes: For disputes involving Non-Resident Indian (NRI) Users, if the dispute is not resolved informally within thirty (30) days, it may be resolved through individual arbitration under the Arbitration and Conciliation Act, 1996 (as amended), conducted by a sole arbitrator appointed by Qubitlance. The seat of arbitration shall be Jaipur, Rajasthan, India. The language of arbitration shall be English.
No Class Actions: You agree that any dispute resolution will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

21. Grievance Redressal

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Digital Personal Data Protection Act, 2023:

You may also raise a support ticket directly from your dashboard for faster resolution.
Acknowledgement: All grievances will be acknowledged within twenty-four (24) hours of receipt.
Resolution: KP will endeavour to resolve all grievances within fifteen (15) days from the date of receipt, in accordance with applicable rules.
If you are not satisfied with the resolution, you may approach the appropriate regulatory authority or court of competent jurisdiction.

22. Severability, Waiver, and Entire Agreement

Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Waiver: The failure of KP to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
Entire Agreement: These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Qubitlance with respect to your use of the Platform.
